TERMS AND CONDITIONS OF USE – FAST EPC LONDON LTD

These Terms and Conditions (“Terms”) set out the basis on which FAST EPC LONDON LTD (“we”, “us”, “our”) provides energy assessment and related services and on which you may use our website and online booking system.

By using our website, placing an order or booking a service, you agree to be bound by these Terms. If you do not agree, you must not use the website or book services.

We operate in England, with a focus on London and surrounding local areas.

2. Services

We provide property-related services including:

  • Domestic (residential) Energy Performance Certificates (EPCs)

  • Commercial EPCs (where specified)

  • Floorplans

  • Gas safety certificates.

The specific services available, service areas and prices may change from time to time and are shown on our website or confirmed in writing.

We reserve the right to refuse a booking or cancel a service where the property is outside our service area, unsafe to inspect, or where we reasonably consider the job to be unsuitable for our capabilities.

3. Eligibility

By placing an order or booking a service, you confirm that:

  • You are at least 18 years old

  • You are resident in the United Kingdom

  • You are the owner, landlord, managing agent or authorised person responsible for arranging the assessment at the property in question.

4. Booking process and contract formation

You can make an enquiry or booking:

  • Via our website using the online forms and payment system

  • By phone

  • By email.

A binding contract between you and FAST EPC LONDON LTD is formed when we:

  1. Confirm acceptance of your booking (for example by email), and

  2. Receive payment in full (where payment is made online in advance).

We reserve the right to decline any booking request at our discretion. If we decline a booking after payment has been taken, we will refund the payment in full.

5. Prices and payment

Prices for our services are displayed on the website or provided in writing. We may change prices at any time, but such changes will not affect confirmed and accepted bookings.

Unless stated otherwise:

  • Prices are in pounds sterling (GBP)

  • Prices are inclusive of any applicable VAT (if chargeable) or we will clearly state if VAT is to be added.

Payment terms

  • For online bookings, payment is taken in full at the time of booking, using the Forminator payment form integrated with Stripe.

  • We do not store full card details; payment is processed securely by Stripe on our behalf.

  • Your booking is not confirmed until payment has been successfully authorised.

If a payment is later reversed or charged back, we reserve the right to cancel the booking or withhold reports and certificates until the matter is resolved.

6. Access to the property

You are responsible for ensuring that:

  • We have safe and reasonable access to the property on the agreed date and time

  • A responsible adult (18+) is present to allow entry, where required

  • Any special access instructions are provided to us in advance

  • Any pets or hazards are controlled so that the assessment can be carried out safely.

If we attend the property at the agreed time and:

  • No one is present to provide access; or

  • We are unable to gain safe access; or

  • The property is not in a suitable condition for inspection,

then no refund will be due, and a further fee may be payable if you wish to re-book.

7. Cancellations and refunds

We understand that plans can change. Our general policy is:

  • If you cancel a booking before we attend the property, and we have not yet travelled or arrived, we may, at our discretion, offer a refund or re-booking.

  • If we fail to attend a confirmed appointment for reasons within our control and cannot agree an alternative suitable time with you, we will refund any payment you have made for that appointment.

However:

  • If we attend the property at the agreed time but you are not there, or access is not possible for reasons outside our control, no refund will be given.

  • Once the assessment has been carried out and the EPC or report produced in line with the relevant standards, refunds will not normally be provided.

Your statutory rights as a consumer under UK law are not affected.

8. Your responsibilities

You are responsible for:

  • Providing accurate and complete information when booking

  • Ensuring that the details of the property are correct

  • Informing us of any known health and safety issues at the property

  • Reviewing the delivered EPC or report promptly and notifying us of any concerns.

If you provide incorrect information that affects the assessment or pricing (for example, incorrect property size or location), we may adjust the fee, refuse the job or require additional payment before continuing.

9. Our obligations and limitations

We will carry out assessments with reasonable skill and care and in accordance with:

  • Applicable legislation and official guidance relating to EPCs and gas safety

  • The rules of our accreditation schemes (Quidos and Elmhurst) and relevant scheme operating requirements.

However:

  • An EPC provides an assessment of the property’s energy performance at the time of inspection. It is based on visual inspection and information reasonably available to the assessor; it is not an exhaustive survey of the building structure or services.

  • We cannot guarantee that the rating will remain accurate if changes are made to the property after the visit.

  • We are not responsible for any decisions you make on the basis of the EPC or report (for example, lending decisions, mortgage offers or letting decisions by third parties).

To the fullest extent permitted by law:

  • We exclude all implied warranties, conditions and other terms that might otherwise be implied by statute or common law.

  • We will not be liable for any indirect or consequential loss, including loss of profits, business, goodwill or data.

Our total liability to you, whether in contract, tort (including negligence) or otherwise, arising out of or in connection with any single service, shall be limited to the total amount paid by you to us for that service, except in cases of death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be limited.

10. Intellectual property and website use

All content on our website, including text, logos, graphics, layout and images, is owned by us or used under licence. You may:

  • View pages and content for your own non-commercial use

  • Print or download extracts for your personal reference.

You must not:

  • Reproduce, copy, modify or distribute website content for commercial purposes without our written consent

  • Use our website in any way that is unlawful, fraudulent or could damage the site or its security

  • Attempt to gain unauthorised access to any part of the website, server or related systems.

We do not guarantee that the website will always be available or error-free, and we may suspend or withdraw the site or any part of it at any time.

11. Third-party websites

Our website may contain links to third-party websites (for example, accreditation bodies, EPC registers or guidance pages). These links are provided for information only.

We have no control over and are not responsible for the content, security, or privacy practices of third-party sites. Following such links is at your own risk.

12. Data protection and privacy

We will handle personal data about you in accordance with our Privacy Policy, which forms part of these Terms. By using our website and booking our services, you acknowledge that you have read and understood our Privacy Policy.

13. Force majeure

We will not be liable for any failure or delay in performing our obligations where that failure or delay results from events or circumstances beyond our reasonable control, including but not limited to: severe weather, public transport disruption, illness, accidents, strikes, pandemics, power failures, or restrictions imposed by authorities.

In such cases, we will use reasonable efforts to rearrange appointments or otherwise minimise disruption.

14. Changes to these Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the website or our services after changes have been posted constitutes your acceptance of the revised Terms.

15. Governing law and jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes), shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter.
